How Is Child Support Determined?
There are a number of factors used to determine the amount of child support that will be paid to one party or the other. If there is a case where child support is at issue, a Child Support Guidelines Worksheet must be filed. Child Support Guidelines Worksheets usually accompany a Family Law Financial Affidavit so as to verify the income of the party or parties filing the guidelines. Some of the factors used to determine child support are:
- Net Monthly Income
- Percent of Financial Responsibility
- Child Care Costs
- Health Insurance Costs
- Uncovered Medical Expenses
- Percentage of Overnight Stays with Each Parent
- Child Care Costs
In some cases, child support may not necessarily be ordered based on the child support guidelines. If an agreement has been made between the mother and father, the parties will have to request the Court to allow a deviation from the child support guidelines.

Jeffrey: Child support is a formula, essentially. There are guidelines and we basically look at both parents’ incomes and we calculate a number based on the number of overnights that the children are with each parent. So your time-share schedule comes into play as a factor and each parents’ income or what their income could be. There are times when we have to actually impute income to a parent who many not be working at the time, but we look at what their historical earnings are or what their ability to earn is.
